This week, a new report was released by our International Human Rights Law Clinic, the UC Berkeley Human Rights Center and Tulane University. This joint study makes policy-level recommendations about working conditions in New Orleans after Katrina. Also contributing expertise to matters of national import, the Samuelson Law, Technology & Public Policy Clinic released a report providing recommendations for public video surveillance.

Worker Abuse in Katrina Reconstruction, UC Berkeley-Tulane Study Reveals
Undocumented workers helping to rebuild New Orleans in the wake of Hurricane Katrina lack adequate access to health care, are subject to wage discrepancy and are operating under unsafe working conditions, among other employment rights violations, according to new study released today by researchers at the University of California, Berkeley and Tulane University.

The International Human Rights Law Clinic at Boalt Hall and UC Berkeley's Human Rights Center joined with researchers from Tulane's Payson Center for International Development and Technology Transfer in a comprehensive survey of more than 200 workers in March. The study found that a quarter of the workforce involved in reconstruction efforts is made up of undocumented Latinos, hired after the federal government granted special waivers of immigration employment laws in the aftermath of the storm.

Are They Watching You?
With an increasing number of communities installing public video cameras, the Samuelson Law, Technology & Public Policy Clinic has issued a joint report providing local and stated officials with parameters for video surveillance. The report, released at the end of May, addresses how communities can establish video surveillance systems that protect privacy rights and civil liberties. It focuses on principles governing the creation and design of public video surveillance systems, procedures to ensure that public officials remain accountable for long-term and temporary surveillance operations, and guidelines for using public video surveillance systems and protecting data collected from misuse.

Samuelson Clinic Director Professor Deirdre Mulligan is expected to address issues related to both privacy in public and matters raised in the report when she testifies before the U.S. Department of Homeland Security's Privacy Advisory Board today. The Samuelson Clinic is also finalizing model legislation for release later this summer based on the surveillance report.

2 Rooms x 3 Months = 4 New Seminar Rooms
Renovation is underway that will transform two large classrooms at Boalt into updated space to accommodate seminar-style classes. Come this fall, the Moot Court classroom in 115 Boalt will blossom into three seminar rooms holding 16 to 20 students each, while the defunct student mail room in 145 Boalt will become seminar space for 20 students. The new seminar rooms will meet current standards for ergonomics and instructional technology, not to mention energy-efficient design. The remodeling will also include installation of video projection facilities and soundproofing.

Dean Congratulates Grads at Commencement
Boalt's own Dean Christopher Edley addressed more than 350 graduates at commencement on May 13. In an exuberant speech, Edley promised to pursue greatness for Boalt, and—on a more poignant note—exhorted the class to "forever be students—of the law, and of our society, of humankind's hopes and needs."

"Howard Dean could not be here," Edley told graduates and guests gathered under sunny skies at the Hearst Greek Theatre. "But if he were here, what would he say? We're going to California and Texas and New York….and to Washington, D.C., to take back the White House…….And then we're going to invest more in financial aid, and guarantee freedom of career choice; and we're going to expand the faculty by 40 percent; and build 10 world-leading think tanks; and a new building to put it all in…..and then we're going to be the best in the state, the best in the country, the world, the solar system and the history of the universe! YEEEAAAAHH!"

Edley paid special tribute to the Class of 2006 for a record-breaking class campaign in which 97 percent of the graduating students made a gift to Boalt. "Your support is simply beyond belief," he remarked, "and will have a powerful impact on your fellow alumni. I've seen it already."

Commencement faculty speaker Professor Emeritus Michael Heyman recounted events that marked the history of the Greek Theatre and described the many changes that have transformed Boalt since he joined the faculty in 1959. Noting that the "study of law is the study of complex social and business relationships," Heyman encouraged the graduates to take advantage of a life that will be "full of opportunities."

University of Cologne Honors Associate Dean Buxbaum
An honorary degree. It’s one of the greatest distinctions that a university can bestow in recognition of the contributions a person has made in their field.

We are proud to share the news that Associate Dean Richard Buxbaum '53 (LL.M.) was awarded an honorary doctor of law degree by the University of Cologne, which has had a unique relationship with Boalt Hall since 1956. Buxbaum is the sixth Berkeley colleague to be awarded an honorary degree from the university. He joins Deans William Prosser and Sanford Kadish and Professors Albert Ehrenzweig, Stefan Riesenfeld '37 and Mel Eisenberg (who received this honor in 2004) in this lineage, which represents a plurality of all honorary degrees Cologne has awarded in that half-century.

With the Cologne honor joining earlier ones of 1992 from Eötvös Lorand University (Budapest) and Osnabrück University along with an appointment as Honorary Professor at Peking University in 1998, Buxbaum now is a Dr. h.c. mult. in the German parlance—"it's more enjoyable than having to earn your own," he said.

Boalt Honors Nobel Prize Winner
Given annually to an international legal scholar or practitioner who has made an outstanding contribution in the field, the Riesenfeld Award honors the memory and scholarship of Stefan A. Riesenfeld '37, a renowned legal expert and longtime Boalt professor. Nobel Peace Prize Laureate Shirin Ebadi, received the 2006 Stefan A. Riesenfeld Award in May.

David Caron '83, the C. William Maxeiner Distinguished Professor of Law, praised Ebadi for her inspirational contributions "to the progressive development and realization of fundamental human rights that also mirror the values of Boalt's legendary figures—Stefan Riesenfeld and Frank Newman '41—its alumni, and the current faculty, staff and students that make up Boalt Hall." Caron received the Riesenfeld Award in 2000. Associate Dean Richard Buxbaum '53 (LL.M.), the 2004 Riesenfeld recipient, presented Ebadi with the award.

Compensation on Campus
The Board of Regents and UC President Robert C. Dynes have responded to concerns about compensation policies and practices—launching extensive audits and acknowledging the need for greater accountability and transparency in all aspects of compensation. The campus has established a website focused on this complex and important issue.

Alan Auerbach Shares Expertise Regarding Federal Tax Cuts
Alan Auerbach's tax expertise was featured in The New York Times and the San Francisco Chronicle in May. The Times article, "'Temporary' Tax Cuts Have a Way of Becoming Permanent," cites Auerbach's analysis of the latest budget trends, where he and two other economists found that diminishing revenues are the main reason for the government's worsening fiscal position. In the Chronicle's "Bush, GOP fail again to fix alternative minimum tax," Auerbach says that President Bush's decision to implement another round of tax cuts will require painful adjustments over the long haul. "We'll have to raise taxes or cut spending for many programs," Auerbach said. "There won't be any other choice."

Eric Talley Discusses Examining Companies Closely Before Investing
On the May 26 public radio broadcast of Marketplace, Eric Talley—Boalt professor, economist and co-director of the Berkeley Center for Law, Business and the Economy—commented on how some major corporations maintain a business strategy of secrecy and how that practice affects investors. Talley is an expert on corporate and commercial law, securities law, law and economics, corporate finance, and empirical methods in the law. Alumni Notes

Nan Joesten '97 Becomes BHAA President-Elect
Nan Joesten '97, an intellectual property litigator with a background as an engineer and brand manager, is the president-elect of the Boalt Hall Alumni Association (BHAA). A current board member, Joesten will assume her new post on July 1, 2007, succeeding Adam Sachs '86.

Joesten is a partner in the Intellectual Property and Technology Group at Farella Braun + Martel in San Francisco. A dedicated and enthusiastic supporter of her alma mater, Joesten joined the BHAA board in 2005. She also chairs the law school's highly successful Partners in Leadership program, an initiative that encourages hundreds of graduates to network with fellow Boalt alumni at their places of work and give an annual gift to the school.

"I'm delighted to contribute to Boalt as the incoming alumni association president, particularly at such an exciting time in our school's history," Joesten said. "Chris Edley is charting a terrific course that will take Boalt’s excellence to new heights. I look forward to building ties with Boalt alumni so we can support his work."

Benjamin Allen '08 Nominated as UC Student Regent
Boalt's own Benjamin Allen '08 has been nominated to serve as student regent for 2007-08. Allen's nomination will be considered at the full board's July meeting. If approved, Allen would then serve as the student regent-designate for the coming year and be able to participate in all deliberations.

Allen reported to The California Aggie, UC Davis' student daily, that he made the decision to apply out of concern for the university's future, especially in the areas of accessibility, affordability, diversity and funding. "I look forward to serving on the Board of Regents both as an advocate for students [and] also as a consensus builder representing the values and goals of the entire UC community." His priorities include looking for creative funding and protecting outreach programs.

This summer, Allen will work as a judicial clerk at the United Nations court established in Tanzania to try the alleged perpetrators of the 1994 Rwanda genocide.

Utah Bar Honors Sean Reyes '97 for Commitment to Diversity
Sean Reyes '97 has been named 2006 Young Lawyer of the Year by the Utah State Bar Association in recognition of his efforts to diversify the profession. A partner handling billion-dollar cases at Utah’s largest law firm, Parsons Behle & Latimer, Reyes is a strong voice for Latino businesses in the state. Reyes currently serves on the board of directors for the Utah Hispanic Chamber of Commerce and actively mentors law students of color, bringing judges and attorneys to meet individually with students and providing one-on-one tutoring.

Honors Abound for JSP Student Mark Massoud '05
Mark Massoud '05, who was recently awarded a UC Berkeley literature prize for a series of stories about "ordinary" life in Sudan, has now won a Fulbright Fellowship. The fellowship will enable Massoud, a doctoral student in the Jurisprudence and Social Policy Program, to pursue his dissertation field work in that North African country.

Massoud worked last summer in Sudan as a legal intern with the Rule of Law Unit of the United Nations Development Programme. A collection of short stories he wrote based on that experience garnered one of this year's Eisner Awards, bestowed by the campus for the "highest achievement in the creative arts."

Monthly Features

Friends of Boalt Hall often support the law school by means of a bequest. These gifts may be made either by will or through a living trust. If you are considering a bequest, you should know that bequests do not take effect until death—you retain control and use of the property during your life and have the benefit of knowing you have left a permanent legacy to Boalt Hall. Bequests may be of a specific dollar amount, a percentage of an estate or the residue of an estate, and may be:

  • designated for a particular purpose or left unrestricted.
  • used to establish or add to an endowed fund (only income is used and principal is held in perpetuity) or a current fund (both income and principal may be used).
  • made to honor the name of the donor or memorialize the name of a loved one.

Making a bequest is straightforward. Simply insert the relevant instructions into your will:

I leave _________________ * to the University of California, Berkeley Foundation to support the Boalt Hall Fund at the School of Law on the Berkeley campus of the University of California.

*For example, "the sum of ________ dollars ($______) or "a percentage (or all) of the residue of my estate."

If you choose to make a bequest, please share your intention with us. Your plans will be kept confidential and a bequest is entirely revocable. However, knowing that such intended gifts exist for the campus allows us to better plan for the future. Notification of the bequest to Boalt's Gift Planning Office will ensure that our staff can act appropriately on your wishes in the future. It will also qualify you for membership in the Boalt Hall Legacy Council, if you wish to be so honored.

Not Quite Da Vinci
With all the media hype about secret messages encoded in great works of art, we were reminded of Boalt's own mystery painting. Hidden in a small locked storage room, within a larger locked storage room, within the deepest bowels of Simon Hall, there is a mutilated portrait which has not yet given up all its secrets.

The oil painting is large—perhaps five feet by four feet—and shows a gentleman lounging comfortably in a slatted chair. Though he has a book before him and a sheaf of paper in one hand, this is no solemn jurist. His moustache curls up playfully at the ends, and his smile stops just short of a smirk. Who is this man? Who painted this striking portrait? And how did the canvas come to be so sadly slashed and punctured? Not even the most senior denizens of the law school could give us any information.

Then one day we were leafing through a 1912 directory titled History of the Bench and Bar of California when our eyes were arrested by a small oval photograph. There he was! To unravel at least part of the mystery we needed only to look at the attorney's name: Charles S. Wheeler.

Charles Stetson Wheeler was a partner in the firm of Garber, Boalt & Bishop, and after John Boalt’s death, Wheeler became the personal attorney and financial advisor of Elizabeth Boalt. Wheeler (no relation to Benjamin Ide) was a Cal graduate, a life-long Bears backer, and eventually a Regent, and it was almost certainly Charles Wheeler who advised Mrs. Boalt that the Department of Jurisprudence was seeking funds to build a new building—a building which would be a fitting memorial to her late husband. Without Charles Wheeler, there would be no Boalt Hall.

Yet sadly, the damaged portrait lies, covered with dust, locked in a room within a room where only someone with a special key may see it. Someday perhaps the law school will find the funds to repair, clean and rehang this striking portrait of a man who played such an important role in our history. And perhaps then we will find out more about that sly, enigmatic smile.

This summer, you have the opportunity to attend the annual International Association of Boalt Alumni (IABA) meeting back at Boalt. We hope you're planning to join us from July 14-16, for this special reunion.

We have a full program planned. In addition to faculty workshops and excursions, we'll be celebrating the 50th anniversary of Boalt's participation in the postwar expansion of International Legal Studies generously funded by The Ford Foundation. Several members of the graduating classes from the 1960s and 1970s, who were supported for post-graduate study abroad, will be with us to reflect on those times. Also joining us will be Dean Christopher Edley, and Professors David D. Caron '83, Mel Eisenberg, Sandy Kadish, Laurent Mayali, David Sklansky and Frank Zimring, as well as other members of the Boalt community.

Now Accepting Nominations for Social Justice Prize
The Center for Social Justice at Boalt Hall is currently accepting nominations for the first annual Judge Thelton E. Henderson Social Justice Prize, which the Center will award yearly to a Boalt Hall alum who is pursuing a career dedicated to social justice.

The prize celebrates the notable contributions Judge Thelton E. Henderson '62 has made to the bar and the bench. Judge Henderson, one of Boalt's most esteemed and distinguished graduates, is chief judge emeritus of the U.S.District Court for the Northern District of California, where he has served since his appointment in 1980.

The winner of the Judge Thelton E. Henderson will be announced at a gala dinner on Friday, September 15, at 6:30 pm at San Francisco City Hall.

Center for Youth Development Through Law
The Center for Youth Development Through Law provides classes at Boalt Hall and law-related internships to disadvantaged Bay Area teens who are interested in legal careers. Class of 1961 Reunion Weekend
In celebration of its 45th, the class of 1961 reunion is planned in the Napa Valley. Enjoy a weekend of wine tasting with your classmates! On Saturday, a special dinner will be held at Larkmead Vineyards, Calistoga, and on Sunday, brunch at Brix Restaurant, Yountville. Check out more information and sign-up.

Class of 1966 Reunion Weekend
Come to the Napa Valley in celebration of your 40th reunion. Your classmates have planned a special wine tour and tasting on Saturday at St. Supery Winery, followed by dinner at the nearby home of Dana and Gary Shapiro '66.
