Description: This panel will discuss the current prosecution process (including the Miyazaki test for claim indefiniteness and new USPTO Examination Guidelines for Determining Compliance with 35 USC §112) as well as possible changes to the process (including proposals in the recent FTC report for improving the notice function of patents). Does the current USPTO process provide an adequate basis for judges and the relevant public to construe claims? Can it be improved without placing undue burdens on patent applicants and examiners?

What will be the impact of the patent reform legislation?
